I have been watching this thread as I have the same problem, I  
installed the cvs drivers from linuxtv over the weekend and had a 0  
length record tonight (this nightly show does it all the time). So I  
would say it not fixed in the new drivers :(

Im going to try toms patch now and see how it goes. Heres hoping !
