Right now I have nothing in modprobe.conf for my pvr-250 before I got errors
when I had 
# ivtv modules setup
alias char-major-81 videodev
alias char-major-81-0 ivtv

now the card captures video below 13 but snow above that.
Any idea as to what and how to tell it the right tuner?

This could be due to an incorrect tuner being detected - were you
specifying a particular tuner for ivtv in your modprobe.conf file?
