Thanks, Kevin and others who provided the files unfortunately my hunch 
was wrong.

Neil kindly make available an iso image that I could try and I can 
actually reproduce the problem both in xine and on a standalone player 
with the iso he created but all my DVD's created locally work fine. So 
one possibility is that we are using different versions of some of the 
tools that are used to create the DVD's. The most likely culprit is 
dvdauthor/spumux but it wont hurt to compare some of the other tools to 
be sure. If you could check your versions with mine.

Here's what I'm using on gentoo:-

spumux
DVDAuthor::spumux, version 0.6.11.
Build options: gnugetopt magick iconv freetype

dvdauthor
DVDAuthor::dvdauthor, version 0.6.11.
Build options: gnugetopt magick iconv freetype

PIL-imaging module for python 1.1.4

mjpegtools 1.6.2 (mpeg2enc and png2yuv come from here)

mplex
mjpegtools mplex-2 version 1.6.2 (2.2.3)
