There was a similar issue in a patch related to scheduling on Ubuntu's 2.6.24.
In between ABI bumps from 2.6.24-16 to 2.6.24-17 it got resolved by pulling a patch.

I suspect the scheduler for 2.6.25 was pulled into Ubuntu, and then when there
was a realization that it was broke, then the patch was added.
