A false dichotomy AND the old "jealousy" argument.

We blame them for exploiting a flawed legal system.

Just because you can legally get away with something doesn't mean you
should do it ethically. Competing on features and price would be the
prefered strategy that many of us would prefer that Tivo Corp employed.

This would yield more immediate benefits to users.

Suing the competitors that force Tivo to adapt or die does me no good. 

My Tivos are collecting dust because Tivo was more interested in 
litigation than engineering. If I am going to use a Tivo it will
because I choose to do so and not because I am forced into it.
