I admit I have not read the original class action suit details, but
IIRC, these kinds of suits were brought because the *formatted*
capacity was less than the *advertised (unformatted)* capacity.  Just
another lame excuse for a class action lawsuit IMHO because the
difference depends on what the disk is formatted -- FAT, FAT32, EXT,
EXT2, EXT3, ZFS...
