There are ways to access encrypted transmissions. DVB users can use
hardware CI modules and smart cards. US cable users can use
Cablecards. The problem is that alternatives to these decryption
methods exist outside the control of the content provider, and thus can
be, and primarily are, use to access content outside of a subscription.
If NA satellite providers had used more traditional encryption schemes,
a DVB-S tuner with CAM would be a perfectly valid means of recording the
content.
