That is correct for Time Warner Cable. Comcast has
(historically) been different, and in any case, CCI
none and CGMS protected is a wrong configuration
(the CCI flag being specified as none is different than
a CCI flag being unspecified).
Is the OP sure the CCI is none and not unspecified?
If CCI is present, CGMS should be ignored(*). Only
if the CCI is unspecified should the CGMS be (currently)
respected(**). And CCI should always be specified
(and not being specified is the usual brokenness for
some MSOs).

(*) I think for some OCUR tuners there was a firmware
update that fixed this. Be sure you are running recent
firmware.
(**) As I understand it there is a pending CableLabs
"clarification" request for when the CCI is unspecified
for an OCUR device to ignore the CGMS values.
